The Colorado Exclusive Right to Buy Contract is a legally binding agreement between a buyer and a real estate broker that establishes the broker’s exclusive right to represent the buyer in purchasing a property. Key aspects include:

  • Exclusive Representation: The broker has the sole right to represent the buyer in locating and negotiating the purchase of a property.

  • Broker Compensation: Specifies how the broker will be compensated, including potential payments from the buyer or seller.

  • Term and Termination: Includes a defined period for the agreement and conditions for termination.

  • Obligations of the Parties: Details the duties of both the buyer and the broker, ensuring compliance with Colorado real estate laws.

  • Legal Considerations: The broker must avoid conflicts of interest and adhere to legal and ethical requirements when advising the buyer.

Additionally, under Colorado real estate regulations, brokers are prohibited from negotiating an exclusive right to buy contract with a buyer who already has an unexpired exclusive agreement with another broker.
